International Shipping, Customs, and Import Duties

1. Importer of Record and Landed Costs All orders are shipped internationally from our facilities in Kunming, China. By placing an order for international delivery, you acknowledge that you are the Importer of Record for the destination country. While we utilize third-party software (such as Zonos) to calculate and collect estimated duties, taxes, and landed costs at checkout for your convenience, you remain ultimately responsible for any additional import duties, value-added taxes (VAT), or customs fees levied by your local government.

2. Customs Inspections and Agricultural Restrictions Our products consist of preserved, natural floral materials. While our preservation processes are designed to meet general international export standards, every country maintains its own strict agricultural, quarantine, and customs regulations. It is your responsibility to verify that preserved floral products are permitted for import into your specific country. We are not liable for any delays, additional inspection fees, or the seizure and destruction of goods by local customs or agricultural authorities. Refunds will not be issued for orders denied entry by a destination country’s customs agency.

3. Shipping Timelines and Delays Any delivery dates provided at checkout or in confirmation emails are estimates, not guarantees. Cross-border logistics are subject to variables outside of our control, including courier network disruptions, severe weather, and customs processing times. We do not assume liability for transit delays once a package has been handed over to our international shipping partners.


Returns, Replacements, and Refunds

1. Final Sale Policy Due to the delicate nature of preserved floral products and the complexities of international logistics, all sales are considered final. We do not accept returns or offer refunds for buyer’s remorse, change of mind, or shipping delays caused by customs processing.

2. Items Damaged in Transit We utilize specialized corrugated packaging—including stem stabilizers and divider grids—to secure and protect your arrangements during global transit. However, if your order arrives damaged, we are committed to making it right. You must report any transit damage to our customer service team at support@blooms.direct within 48 hours of the recorded delivery time.

3. Submitting a Damage Claim To process a replacement or refund for a damaged item, your claim must include clear photographic evidence of both the damaged floral arrangement and the original shipping box. Upon review of the provided evidence, we will, at our sole discretion, offer either a replacement of the damaged arrangement or a refund for the purchase price of the affected items.

4. Return Shipping Exemption In most cases involving transit damage, we will not require you to ship the damaged preserved flowers back to our facilities in Kunming. If a physical return is deemed necessary for quality assurance purposes, our support team will provide specific instructions, and we will cover the cost of return shipping.


Product Representations and Natural Variations

1. Natural Characteristics All floral arrangements sold by Blooms.Direct are composed of real, natural flowers sourced from the Dounan Flower Market that have undergone a specialized preservation process. Because these are authentic, organic materials, no two flowers or completed arrangements are exactly alike.

2. Acceptable Variations By placing an order, you acknowledge and agree that slight natural variations in petal color, blossom size, shape, and overall arrangement dimensions are to be expected. While we adhere to strict design methodologies and target precise stem counts for our focal, line, and filler flowers, the inherent nature of real botanicals means the physical product you receive may differ slightly from the representative promotional photography displayed on our storefront.

3. Color Accuracy We make every effort to display the colors of our preserved florals—including specific custom color palettes—as accurately as possible. However, we cannot guarantee that your monitor or device’s screen will perfectly reflect the exact hues of the physical product. Such natural organic variations and digital display differences do not constitute a product defect or a misrepresentation of the goods.


Governing Law and Dispute Resolution

1. Governing Law These Terms and Conditions, and any separate agreements whereby we provide you products or services, shall be governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law principles.

2. Informal Resolution In the event of any dispute, claim, or controversy arising out of or relating to your purchase, these Terms, or your use of the Blooms.Direct storefront, both parties agree to first attempt to resolve the issue informally and in good faith. Please contact our team at legal@blooms.direct with a detailed description of your concern before initiating any formal proceedings.

3. Jurisdiction and Venue If a dispute cannot be resolved through informal negotiations within thirty (30) days, you expressly agree that any legal action or proceeding shall be brought exclusively in the competent courts located in Kunming, Yunnan Province, People’s Republic of China. By using our website and purchasing our products, you consent to the exclusive personal jurisdiction and venue of these courts and waive any objections to such jurisdiction or venue.
